NAACP Sues Elon Musk's xAI Over Unpermitted Gas Turbines at Memphis Data Center

A major environmental lawsuit has been filed against Elon Musk's artificial intelligence company, xAI, challenging the legality of its power operations at a key data center cluster in the Memphis area. The case highlights the growing tension between the rapid expansion of energy-intensive AI infrastructure and environmental regulations, particularly in communities that have historically borne a disproportionate burden of industrial pollution.
The civil rights organization NAACP, represented by the Southern Environmental Law Center and Earthjustice, formally launched the lawsuit against xAI and its subsidiary MZX Tech. The complaint alleges that 27 methane gas turbines powering the company's "Colossus 2" data center in South Memphis are operating without a required permit under the Clean Air Act. The NAACP asserts that the facility, located near homes, schools, and churches, poses significant health risks to the predominantly Black communities in North Mississippi and Memphis.
"A data center should not be a potential death sentence for a community’s health," said Abre Conner, NAACP director of environmental and climate justice. "By looking to evade clear air laws to operate dirty turbines that emit pollution and known carcinogens, these companies are following a shameful, familiar pattern: asking black and frontline communities to bear the toxic brunt of 'innovation'." The organization claims the unpermitted power plant has the potential to emit over 1,700 tons of nitrogen oxides (NOx), 180 tons of fine particulate matter, 500 tons of carbon monoxide, and 19 tons of the carcinogen formaldehyde annually.
xAI has been operating data centers in the region since 2024, using gas turbines to power its Grok AI chatbot. The Colossus 2 facility, located on a site purchased in March 2025, came online in January 2026. Despite Elon Musk's claims of 1GW capacity at launch, reports based on January satellite imagery indicated cooling infrastructure for approximately 350MW. The company plans a significant expansion, with a third data center underway in Southaven, Mississippi, and a $659 million building on an adjacent parcel. Musk has stated the cluster will eventually access 2GW of compute power, largely supplied by gas turbines, and the company recently received permission to install 41 new turbines.
The lawsuit, to be heard in the Northern Mississippi district court, could set a critical precedent for holding large technology and AI companies accountable to local environmental and health standards during their breakneck expansion. It follows reports that an $80 million water recycling plant in Memphis, touted by xAI as a key community benefit, is now on an "indefinite pause," with Musk stating the company must first focus on stabilizing Colossus 2. Legal counsel for the NAACP emphasized the stakes, with SELC senior attorney Ben Grillot stating, "xAI’s continued operation of these turbines without a permit and without adequate pollution controls is not only illegal, it’s an insult to families living nearby."
